CBS 60 Minutes Nails H1b Immigrant Program Destroying American Jobs

60 Minutes last night did a damning section on the H1b Program which brings workers from foreign countries such as India, China, and Russia to fill American jobs, at salaries less than half what an American Worker makes under the guise that the “is a shortage of qualified American born talent”.

The H1b program has become a complete fraud, stealing over 800,000 of American technical  Jobs. Over the past six years, 775,957 H-1b visas were issued to foreign workers, according to the State Department, which is the last of three federal agencies to approve each successful petition.

These are the legal immigrants taking your jobs dumb-fuck Trumpazoids. Not Jose’ sneaking across the border to pic grapes.

Chumph Winery Begs for H1B Visas…For Cheap Labor to Lay Off Americans

How exactly minimum wage labor became a resource “of particular skill or reknown” where there is a shortage of America talent in America is a good question…

Trump Winery begs Labor Department to hire foreign workers over Americans

Donald J. Trump, the man who’s entire campaign was predicated on bringing American jobs back to America, vows to keep his promise to the people, a Virginia winery owned by son Eric Trump is petitioning to government for the opportunity to hire foreign workers, the New York Post reports.

The request, filed by the Trump Winery on Dec. 2 and posted online by the Department of Labor Wednesday, show that the Trump-owned vineyard is requesting six foreign workers under the federal H-2 program, a temporary work visa that allows US employers bring foreign labor.

According to the application, Trump Vineyard will pay the H-2 workers $10.72 an hour for 40 hours a week, as well as an unpaid lunch break. It will run from January until June 2017.

ABC News reports the winery applied for the 19 visas through the H-2 program in 2016; it made similar requests in 2014 and 2015.

Trump ran on a pro-worker populist platform throughout his campaign, and maintained that image despite numerous reports indicating the president-elect hires foreign workers at his establishments, including his Florida estate Mar-a-Lago.

A New York Times report published in February revealed the Trump Organization rejected hundreds of US applicants in favor of hiring foreign workers:

“[N]early 300 United States residents have applied or been referred for jobs as waiters, waitresses, cooks and housekeepers there,” the New York Times wrote. “But according to federal records, only 17 have been hired. In all but a handful of cases, Mar-a-Lago sought to fill the jobs with hundreds of foreign guest workers from Romania and other countries.”

“You can’t get help,” Trump told MSNBC’s Morning Joe in September, defending his company’s decision to hire guest workers over US citizens. “Getting help in Palm Beach during the season is almost impossible.”

The US Senate’s Diversity Problem…

No real surprise here in America’s Last Plantation. Not much has changed since the 70’s when “The Hill” was one of my assigned accounts and I had reason to frequent the Capital and Office buildings.

The Senate Has Plenty Of Racial Diversity, But Not The Kind You Brag About

High-level Senate staffers are overwhelmingly white. Low-level service workers are overwhelmingly black and Latino.

To a casual observer, the halls of Congress look pretty white. But according to Anthony Thomas, people of color abound there, so long as you know where to find them.

“It’s all black and Hispanic people downstairs,” said Thomas, a 23-year-old African-American from the suburb of New Carrollton, Maryland.

Thomas works as a dishwasher in the Senate cafeteria in the basement of the Dirksen building. His duties include catering special parties held in the Capitol and the Senate office buildings, where lawmakers and staff rub elbows with lobbyists and other power brokers. Though there are exceptions, it’s mostly white people drinking and dining, and people of color like Thomas cleaning up after them, he said.

A report released in December by the Joint Center for Political and Economic Studies found that the most influential Senate staffers are disproportionately white. Among senior-level Senate staff — chiefs of staff, legislative directors and other folks who ultimately shape the laws we all live by — a mere 7.1 percent are people of color, researchers found. Yet people of color comprise 36 percent of the U.S. public at large. (There may well be more diversity among mid- and low-level Senate staff, but no such numbers are available.)

So where is all the Senate’s diversity? Apparently, much of it is concentrated at the opposite end of the power structure.

For the past year and a half, a group called Good Jobs Nation, funded by the Change to Win federation of labor unions, has been organizing janitorial and food workers in the Senate offices and the U.S. Capitol Visitor Center. The group compiled a database of 160 rank-and-file employees it assumes would be eligible to vote if workers filed for a union election. (SEIU, a member of Change to Win, lost a union election among Senate dining employees three years ago, though the union could file for another election.)

When the group examined demographics, it found the makeup of the service workforce to be the exact opposite of the senior-level Senate staff.

The low-wage workers were almost exclusively people of color — a whopping 97 percent, according to a demographic breakdown Good Jobs Nation provided to The Huffington Post (the breakdown did not identify individual workers). That number shouldn’t be all the surprising, given the demographics of D.C. — a majority of residents are people of color — and the way low-wage food and janitorial jobsalready skew heavily toward minorities in the U.S. at large, according to the Bureau of Labor Statistics.

A caveat: This was not a scientific study. The database was compiled through on-the-ground outreach done by the group’s organizers, not through government records or an official survey. And since the group is only organizing rank-and-file employees, the numbers don’t account for middle management, where the workforce appears more mixed. Yet the figures should ring true for anyone who’s taken a close look at the workers cleaning the dishes and mopping the floors in the Senate.

“I think what’s happening at the Capitol reflects a larger trend in our economy — the gap between the knowledge economy workers and the service-sector workers,” said Joseph Geevarghese, director of Good Jobs Nation. “You’ve got a class of workers who are higher paid, and then you have an underclass of service workers who are low-paid and struggling to make ends meet.”…More

The Thugs of Silicon Valley

Bunch of strange stuff has been going on in High-Tech for the last 5-10 years. I have discussed previously the use of H1 Visa employees from other countries to steal American engineering jobs, paying H1’s  half or less than what a qualified American Engineer would get.  Resulting in several hundred thousand American kids who did the right thing, and got a college education in the Tech field…Being unable to get a job.

Then there was the outright age/salary discrimination against experienced and older workers. Resulting in the strange situation where the very guys who invented much of the current technology in the first place…becoming pariahs in the view of company HR.

If that wasn’t criminal enough, now we find that some of the biggest names in the Tech business have participated in a conspiracy, the result of which is to eliminate the ability of American workers to find a new job.

One of the things Unions did back in the days of the Robber Barrons was to break this sort of “restraint of free trade” up. One of the reasons conservatives are so anxious to destroy unions is they know if Unions move from the manufacturing of physical devices into the High-Tech development world…

Theirr clients won’t be able to get away with this shit.

The Techtopus: How Silicon Valley’s most celebrated CEOs conspired to drive down 100,000 tech engineers’ wages

In early 2005, as demand for Silicon Valley engineers began booming, Apple’s Steve Jobs sealed a secret and illegal pact with Google’s Eric Schmidt to artificially push their workers wages lower by agreeing not to recruit each other’s employees, sharing wage scale information, and punishing violators. On February 27, 2005, Bill Campbell, a member of Apple’s board of directors and senior advisor to Google, emailed Jobs to confirm that Eric Schmidt “got directly involved and firmly stopped all efforts to recruit anyone from Apple.”

Later that year, Schmidt instructed his Sr VP for Business Operation Shona Brown to keep the pact a secret and only share information “verbally, since I don’t want to create a paper trail over which we can be sued later?”

These secret conversations and agreements between some of the biggest names in Silicon Valley were first exposed in a Department of Justice antitrust investigation launched by the Obama Administration in 2010. That DOJ suit became the basis of a class action lawsuit filed on behalf of over 100,000 tech employees whose wages were artificially lowered — an estimated $9 billioneffectively stolen by the high-flying companies from their workers to pad company earnings — in the second half of the 2000s. Last week, the 9th Circuit Court of Appeals denied attempts by Apple, Google, Intel, and Adobe to have the lawsuit tossed, and gave final approval for the class action suit to go forward. A jury trial date has been set for May 27 in San Jose, before US District Court judge Lucy Koh, who presided over the Samsung-Apple patent suit.

In a related but separate investigation and ongoing suit, eBay and its former CEO Meg Whitman, now CEO of HP, are being sued by both the federal government and the state of California for arranging a similar, secret wage-theft agreement with Intuit (and possibly Google as well) during the same period.

The secret wage-theft agreements between Apple, Google, Intel, Adobe, Intuit, and Pixar (now owned by Disney) are described in court papers obtained by PandoDaily as “an overarching conspiracy” in violation of the Sherman Antitrust Act and the Clayton Antitrust Act, and at times it reads like something lifted straight out of the robber baron era that produced those laws. Today’s inequality crisis is America’s worst on record since statistics were first recorded a hundred years ago — the only comparison would be to the era of the railroad tycoons in the late 19th century.

Shortly after sealing the pact with Google, Jobs strong-armed Adobe into joining after he complained to CEO Bruce Chizen that Adobe was recruiting Apple’s employees. Chizen sheepishly responded that he thought only a small class of employees were off-limits:

I thought we agreed not to recruit any senior level employees…. I would propose we keep it that way. Open to discuss. It would be good to agree.

Jobs responded by threatening war:

OK, I’ll tell our recruiters they are free to approach any Adobe employee who is not a Sr. Director or VP. Am I understanding your position correctly?

Adobe’s Chizen immediately backed down:

I’d rather agree NOT to actively solicit any employee from either company…..If you are in agreement, I will let my folks know.

The next day, Chizen let his folks — Adobe’s VP of Human Resources — know that “we are not to solicit ANY Apple employees, and visa versa.” Chizen was worried that if he didn’t agree, Jobs would make Adobe pay:

if I tell Steve [Jobs] it’s open season (other than senior managers), he will deliberately poach Adobe just to prove a point. The “Problem” In America Isn’t Immigrants…It’s Guest Workers

 

Been saying this for a while… “Illegal Immigration” isn’t causing a problem with jobs in America. And the conservative types who want to say that Miguel the Farm worker is stealing “back jobs” are full of crap.

Who’s stealing millions of American jobs are “guest workers” using H1 Visas. Now – to my lone conservative reader, that doesn’t mean run out and hang Iqbal in effigy from the nearest lamp post. (It isn’t Iqbal’s fault. Somebody wants to pay me the equivalent of half million a year to go to India to do what I do… I can develop one hell of a taste for curry.)  The people you ought to be hanging (and not just in effigy) have very “American” names and are at the head of the tech companies.

With 3 million black kids currently in college, a historical high – many of these kids are taking courses and earning degrees in the STEM fields. Specifically in Telecommunications and Computer Science. Several studies including the seminal “The Shape of the River” have pointed out that black kids have a harder time achieving a Bachelors than white or Asian kids – but once they do they are about 3.5 times more likely than their white American counterparts to pursue post gradate degrees. Indeed, this has been the motivation by conservatives, and the SCUMUS 5 to try and close that door to higher education through re-instituting Jim Crow in College acceptance by destroying any program where disadvantaged minority kids might get into college even distantly under the banner of Affirmative Action.

Grabbing a bowl of popcorn and a beer, and rolling up in front of the big screen each night to see recounts of the daily carnage in the inner city, as those kids kill each other over nickels and dimes is far more gratifying to conservative’s racism than potentially seeing any of those minority kids join the American commerce as productive members or business owners. It isn’t just having a black President as “the boss” thats sends those folks into racial apoplexy – they have the same reaction to black business folks in leadership positions. As such, the “program” to keep those young folks from getting an education is a Crusade on the 12th Century model of throwing the Muslims out of Jerusalem.

But it isn’t only educated and skilled black folks who are getting screwed here…

The Bogus High-Tech Worker Shortage: How Guest Workers Lower US Wages

Salzman, Lowell and Kuehn: When Bill Clinton was president, wages for American IT workers were climbing and American students were clamoring to become computer scientists. Fifteen years later, average real IT wages are no higher. It is no coincidence that high-tech industries are now using guest workers to fill two-thirds of new IT jobs.

And now they’re asking Congress to provide them with an even greater supply of guest workers — a supply that by the IT industry’s own estimates would equal 150 percent of the expected number of new IT jobs each and every year going forward. With its passage of the comprehensive immigration reform bill, the Senate has complied, putting out a sign for IT jobs that says, “We prefer guest workers.”

The IT industry and its many supporters argue that without this infusion of guest workers it will starve because of the scarcity of domestic native and foreign-born citizens with the right aptitude or interest. Researchers like us, who have the temerity to suggest that the evidence fails to justify importing ever more guest workers, are accused of being anti-immigrant, anti-capitalist, Luddites, or just plain troglodytes who can’t fathom the character of modern technology industries.

For those of us who simply want to get the policy right, however, this is a debate about America’s policies for creating good jobs, strong technology and an innovation-based economy. We welcome immigrants and support an immigration policy that draws the best and the brightest and provides opportunity to newcomers. But policy should not be about targeting government giveaways to a few industries by supplying ever more guest workers when there is an ample domestic supply of qualified graduates and workers.

We’re Already Generating More Qualified Students Than Jobs

Our analysis of the data finds that high-skill guest worker programs supply the preponderance of all new hires for the IT industry. The inflow of guest workers is equal to half of all IT hires each year and fully two-thirds of annual hires of workers younger than 30.

Can it be a coincidence that wages in IT jobs have been stagnant for over a decade? The chart below shows trends for programmer and system analyst jobs; wages for other IT occupations follow similar trends.

In the above graph of average salaries and unemployment rates for computer and IT occupations from 1992-2011, wages for IT workers have held steady over the past decade. This table is reproduced from “Guestworkers In The High-Skill U.S. Labor Market: An Analysis of Supply, Employment, and Wage Trends” (2013) by Salzman, Kuehn and Lowell.

 

At the same time, U.S. colleges are graduating more than twice as many science, technology, engineering and math (STEM) graduates than the number of STEM openings generated by our economy each year. In short, there is little justification to support the escalating numbers of new guest workers called for in the Senate’s S744 legislation.Why then did it pass?

Today’s guest worker programs target an important industry with a substantial hold on the public’s imagination. But guest worker programs should be justified by national interests, not by the shortsighted interests of a particular industry. Proclaiming “shortages” where there is no evidence of them is not only disingenuous, it obscures the likely impact of large-scale guest worker programs, which stand to hurt all STEM grads, but especially minorities who are underrepresented in high-tech, as well as other foreign-born workers who compete most with newcomers. Can anyone argue that prioritizing access to good employment for high-skill domestic workers is not in the national interest?

Isn’t Ours a Market Economy?

Markets are supposed to reflect demand through the price mechanism. In the case of labor, the “price” is wages. How can it be, then, that if the IT industry is experiencing labor shortages, wage levels in this highly profitable industry are no higher than they were in the last millennium? How can an industry expect to attract the best workers without raising wages? Is there what economists call a “market failure” here?

Or is the hidden truth quite simply that large supplies of guest workers allow many firms to swap out higher-paid, high-skill domestic workers for lower-paid, high-skill guest workers? A recent analysis by the Brookings Institution observes that “it is likely that the extra supply of foreign-born workers does bring downward pressure on the wages of incumbent workers, as research suggests.”

All the evidence suggests the IT labor market is still bound by the usual dynamics of supply and demand. When we look at the trends of the past 20 years, we see that when wages increase, the number of computer science graduates increases. When wages fall, the number of graduates falls. When the supply of guest workers increases, wages stay flat, and too many domestic students must find employment in other fields.

Some commentators argue that this last result is good for the economy: science and engineering skills are now being used in millions of non-STEM jobs. But an alternative view is that far too many domestic STEM graduates are in jobs that do not fully use their education, which represents a loss of our greatest source of innovators.

Yes, employers claim they have thousands of unfilled job openings, but the evidence is hardly compelling. Only about half of engineering graduates find engineering jobs, down from previous rates of about two-thirds before the current recession began in 2007. At the largest IT jobs website DICE.com, over half of the advertisements are for contract, short-term and part-time jobs — assuming these jobs exist at all. But even if they are available, these are not the types of jobs that U.S. graduates will find attractive, nor are they the types of jobs that will allow these graduates to pay off student loans, much less enter the middle class….(…more…)

SC State Senator Robert Ford’s “Brothers”

A guy who has never made himself unfamiliar with “Foot in Mouth” affliction – South Carolina (Charleston) State Senator Robert Ford’s phrasing has again landed him in hot water. Now, I think what Ford was trying to say is that every immigrant group in America spent their “time in the bucket” doing work nobody else wanted to do (some in chains). At some point, they got the skill, acceptance, or political control to move up the ladder to higher paying jobs – and aren’t willing to go back to picking cotton or lettuce for $1 an hour…

Jobs which have been filled by the newest immigrant wave.

Unfortunately, Sen Ford doesn’t appear smart, or couth enough to express that in a manner with any level of clarity.

As to his comment on the left – I hope what he is trying to talk about is low wages.

Ford comes under fire for his remarks

Charleston’s black Democratic senator once again has created a racial firestorm.

In a debate over hardening South Carolina’s illegal immigration law, Sen. Robert Ford argued against a new law because “brothers” don’t work as hard as “Mexicans.”

Ford said during a Senate committee meeting Tuesday that the state needs immigrants to fill hard labor jobs, such as construction jobs at the new Boeing plant in North Charleston, because black Americans won’t do the work.

“I know brothers — and I’m talking about black guys — they are not going to do the dirty work at Boeing, to do that hauling and all that building, that dirty work,” Ford said.

He went on to say that “brothers” do not want to perform hard work. “A brother is going to find ways to take a break,” he said.

He later made a comment about “blue-eyed brothers” also not wanting to work hard. Read the rest of this entry »
