Chicago Grand Jury Indicts Three Officers for Alleged Cover-Up of Laquan McDonald Shooting

Three of the Chicago police officers on the scene when Jason Van Dyke shot and killed Laquan McDonald in 2014 have been indicted on charges of conspiracy, obstruction of justice, and official misconduct. They stand accused of lying on incident reports about the moments leading up to Van Dyke’s use of deadly force against the black 17-year-old.

The indictment, which is written in a way that suggests more officers could still be charged for participating in the cover-up, accuses David March, Joseph Walsh, and Thomas Gaffney of allegedly coordinating with Van Dyke—who has been charged with murder—to provide false accounts of the shooting “in order to shield their fellow officer from criminal investigation and prosecution.”

In a report submitted to the Chicago Police Department, Marsh wrote that McDonald had “committed aggravated assaults against the three officers, finally forcing [Van Dyke], in defense of his life, to shoot and kill” him. In a separate report, Walsh wrote that “when MCDONALD got to within 12 to 15 feet of the officers he swung the knife toward the officers in an aggressive manner.” Gaffney submitted a report that said three officers had been “battered” during the run-up to the shooting.

All of these claims were revealed to be lies upon the release of a dashcam video that showed McDonald’s final moments. The release of the video, which sparked protests and led to the ouster of Chicago’s police superintendent, proved McDonald had not threatened or acted in an aggressive manner toward any of the officers in the moments before Van Dyke shot him 16 times.

In the indictment, the officers are accused of mischaracterizing “the video recordings so that independent criminal investigators would not know the truth about the Laquan McDonald killing and the public would not see the video recordings of the events.” It’s unclear at what point the three officers named in the indictment watched the dashcam footage, and what role their descriptions of it may have played in the city’s decision to keep the video out of public view until a judge ordered its release in November 2015.

The outcry over McDonald’s death in the wake of the video’s release spurred the Obama-era Department of Justice to launch an investigation into policing in Chicago. That effort led to a blistering report that found, among other things, that “a code of silence among Chicago police officers exists, extending to lying and affirmative efforts to conceal evidence.”

The Justice Department’s report was supposed to lead to a court-enforced consent decree that would have mandated a reform agenda. The Trump administration, however, has scuttled plans for that consent decree to take effect.

A new indictment unsealed Thursday in the murder case against Chicago police Officer Jason Van Dyke added 16 counts of aggravated battery — one for each time the officer shot Laquan McDonald in 2014.

Joseph McMahon, the Kane County state’s attorney who was appointed special prosecutor in the high-profile case, had previously said his office believed that none of the rounds fired by Van Dyke was legally justified.

In the indictment returned March 16 by a new grand jury, Van Dyke is still charged with six counts of first-degree murder and one count of official misconduct as well.

Van Dyke, who has been suspended without pay since soon after he was first charged in November 2015, pleaded not guilty Thursday to the new indictment through his attorney.

McMahon denied in court that he sought the new indictment to correct what Van Dyke’s attorney, Daniel Herbert, had labeled fatal errors in the initial charges.

“I disagree with Mr. Herbert,” said McMahon, who made it clear, though, that he believed the issues raised by Van Dyke’s motion to dismiss the original indictment “were now moot.”

Herbert had alleged prosecutors misled the original grand jury by instructing them to consider Van Dyke’s actions only under the state’s first-degree murder statute, not under a separate law that governs an officer’s use of force.

He also alleged that prosecutors improperly presented to the grand jury statements that other officers at McDonald’s shooting were required to give by police disciplinary officials. And he also said grand jurors were wrongly told that the 17-year-old McDonald was shot first in the back.

The autopsy report showed that McDonald was shot 16 times in the scalp, neck, both sides of his chest, his back, both arms and his right hand and leg. But authorities have never publicly divulged — if they know — where he was first shot.

Herbert said he planned to file a similar motion to dismiss involving the new indictment after reviewing grand jury testimony given before the indictment was returned March 16.

Through his attorney, Van Dyke again entered a not guilty plea before Judge Vincent Gaughan.

The fallout over the dashboard camera video of the white police officer shooting the black teen has caused the most severe crisis for Mayor Rahm Emanuel in his time in office and led to a blistering report by the U.S. Department of Justice that portrayed a broken Police Department in which officers commit misconduct and use excessive force with little fear of repercussions.

The video showed Van Dyke opening fire within seconds of exiting his police SUV as McDonald walked away from police with a knife in his hand in the middle of the road shortly before 10 p.m. Oct. 20, 2014, contradicting many of the officers’ written accounts that the teen had lunged at police with the knife.

As McDonald walked away from him, Van Dyke took at least one step forward and fired 16 rounds at McDonald in about 14 seconds and was reloading when another officer told him to hold his fire, prosecutors have said.

Hundreds of pages of Chicago police reports showed that Van Dyke and at least five other officers claimed that the McDonald moved or turned threateningly toward officers, even though video of the shooting showed McDonald walking away.

Authorities said McDonald had PCP in his system at the time of his death.

Police Superintendent Eddie Johnson is seeking to fire Van Dyke and four other officers whose accounts did not match the video.

McMahon has asked that the Chicago Police Board, which will decide on the firings, to hold off on hearings until after Van Dyke’s criminal trial to minimize publicity that could affect the trial’s jury selection.

However, most Chicago police officers charged with misconduct have opted to put their fate in the hands of a judge, not a jury.

At Thursday’s hearing, an attorney for the police board said the board has agreed to hold off on an evidentiary hearing in Van Dyke’s case until Gaughan, who is presiding over the officer’s criminal trial, rules on the issue.

Gaughan, who has routinely held lengthy off-the-record discussions with the attorneys in the case in his chambers at each status hearing, held to form Thursday, meeting privately with the attorneys — without a court reporter present — for about 45 minutes. The public discussion in his courtroom then lasted about 15 minutes.

BOOM! Attorney who bungled Laquan McDonald case loses re-election bid

After criticism for alleged mishandling the shooting death of Laquan McDonald Cook County State’s Attorney Anita Alvarez went down in her election Tuesday night. McDonald was the 17-year-old Chicago boy who was shot 16 times as he walked away from officers with a 3-inch knife. The video footage of his death was withheld while Chicago Mayor Rahm Emanuel ran for reelection. Alvarez too was seen responsible after waiting 13 months before filing charges against Officer Jason Van Dyke who shot McDonald.

Alvarez was also blamed for declining to file charges against officers who fatally shot a total of 68 people in the last seven years.

Alvarez’s opponent Kim Foxx had nearly 58 percent of the vote to Alvarez’s 29 percent before Alvarez conceded the race at 9 p.m. CDT.

“We are obviously very disappointed,” campaign manager Mike Carson said according to DNAInfo. “This was a hard-fought campaign.”

Opponents to Alvarez started a Twitter the hashtag #ByeAnita demanding she resign from the post. The movement was led by young black activists who used the direct action in the Black Lives Matter movement for the election. The group didn’t endorse an opponent, and they were just in opposition to Alvarez, spending a mere $1,000.

“I have been criticized that I wasn’t a very good politician and that’s probably right,” Alvarez said, “and that’s probably why I stand before you tonight.”

“Not a good politician”? How about a lousy human being.

Cops didn’t know this camera caught them deleting video of the murder of Laquan McDonald

Accused of deleting the surveillance video of 17-year-old Laquan McDonald’s death, several officers appeared in recently released screenshots tampering with Burger King’s computers before the footage mysteriously disappeared. Although 86 minutes of the surveillance video have gone missing, including the moment that McDonald was gunned down, Cook County State’s Attorney Anita Alvarez claims no one tampered with the footage.

Surrounded by officers and suspected of breaking into cars on October 20, 2014, Laquan McDonald, 17, was attempting to walk away from a group of Chicago cops when Officer Jason Van Dyke exited his patrol car. According to initial reports, McDonald was armed with a knife and lunged at Officer Van Dyke. Fearing for his life and the lives of his fellow officers, Van Dyke shot the teen in the chest out of self-defense.

But according to witness statements and police dashcam video, McDonald was walking away when Van Dyke opened fire. After McDonald had collapsed to the ground in a near-fetal position, Van Dyke continued firing his weapon until emptying his clip. Chicago Mayor Fires City’s Top Cop In Wake Of Laquan McDonald Criticism

The Chicago Police Department’s top cop has been fired.

Mayor Rahm Emanuel said Tuesday that he had formally asked for the resignation of Superintendent Garry McCarthy, whom he hand-picked to lead the department in 2011.

McCarthy has faced harsh criticism for his handling of the high-profile shooting of Laquan McDonald, a black teenager shot 16 times in 2014 by a white Chicago police officer.

Emanuel praised McCarthy Tuesday as an “excellent leader” throughout his tenure, but said his appointee was now “a distraction” as the department grapples internally with misconduct and externally with mistrust from the community. The mayor said the department’s leadership had been “shaken.”

“I have a lot support and confidence in the work and results he has done,” Emanuel said of McCarthy. “But our goal is to build the trust and confidence with the public.”

“At this point — in this juncture in the city — he has become an issue rather than dealing with the issue,” he said.

Chief John Escalante, McCarthy’s deputy, will lead the department until a new superintendent is appointed.

Conservative Black Child YouTube Darling Has an Epiphany

Viral conservative YouTube star CJ Pearson turns his back on the GOP because of Laquan McDonald video

Back in the 1990s, I was groomed to be aconservative activist. This was before the days of viral YouTube videos and smartphones. In those days, the Internet was confined to clunky desktop computers on dial-up connections. Whenever we could, we’d advocate for conservative political campaigns or participate in anti-abortion rallies.

I was taught to call into AM radio talk shows to repeat conservative talking points, or write letters to newspapers about abortion and family values. Eventually, I became an adult and began my exodus from the Republican party. Looking back now, it is extremely embarrassing to think about, but it was a learning experience that I now use against the right-wing.

Over the past year or so, right-wing websites have made a big deal about young man from Georgia named CJ Pearson. Mr. Pearson is an African-American teenager who has gained a lot of attention in conservative circles for his videos bashing President Obama and Democrats.

Now CJ Pearson has apparently renounced his activism for the Republican Party and has announced his intentions to be independent in his viewpoints.

“Over the past few days, I thought about essentially how I don’t want people to follow me because I’m that anti-Obama kid, or who called out Hillary Clinton or who took Bernie Sanders to task,” Pearson said. “I don’t want to be the conservative wonder kid that people follow because I make them feel good and like young people are part of their movement. I want to be followed because I’m the voice of a generation that doesn’t have a voice at the table.”

He said the video of Laquan McDonald being shot 16 times by a police officer in Chicago helped open his eyes to the systemic problems of racial discrimination in America and the need to look at the issues objectively. (Source)

I’m going to remain skeptical on this announcement, considering the fact that this young man has a history of making things up – including the claim that he was blocked by President Obama on Twitter. I have no doubt that his parents have used his Internet fame for their own benefit, which is par for the course for political activism and our society’s obsession with going viral.

CJ Pearson was also named as a youth leader for Ted Cruz’s campaign, and has been a conservative celebrity on social media. Now, if we’re taking him at his word, he wants to turn away from that and become independent.

Here’s my advice for CJ Pearson, as someone who was indoctrinated into right-wing politicsat an early age: go enjoy being a kid and leave the politics behind. Both liberals and conservatives love to use kids as props for their agenda, and they’re both convinced that what they’re doing is right and justified.

You’re only a kid once, and once you’re an adult, you can decide whether you want to be a progressive or a conservative. Put the political agendas that other people want to use you for aside, and go be a kid. Take it from me, you’re only young once.

Chicago Cop Who Murdered Laquan McDonald to be Charged

Another Killer Cop in Chicago looks like he is headed to trial for the killing of a 17 year old black kid.

Reports: Chicago police officer to be charged with murder of black teen shot 16 times

A white Chicago police officer is expected to be charged with murder in the 2014 shooting death of an African American teenager caught on dash-cam video, sources close to the investigation told the Associated Press, the Chicago Tribune and the Chicago Sun-Times Monday night.

Unnamed officials told the news organizations that Officer Jason Van Dyke is expected to appear at a bond hearing at noon Tuesday at which time he is also expected to be charged with murder. His lawyer has said that the officer’s actions were lawful.

“He believed in his heart of hearts that he was in fear for his life…he was concerned about the lives of [other] police officers,” Daniel Herbert told reporters last week.

If Van Dyke is indicted, the case will mark the first time a Chicago police officer has been charged with first-degree murder for an on-duty fatality in 35 years, according to the Tribune.

These reports come just a week after a judge ruled that the footage of the shooting must be released to the public by Wednesday.

Mayor Rahm Emanuel’s administration has been accused of withholding incriminating evidence over the course of a 13-month investigation into the incident.

Like so many deaths at the hands of police, Laquan McDonald’s seemed at first destined to be mired in an unending he-said, she-said.

The Chicago Police Department initially stated that McDonald, a 17-year-old African American, “lunged” at officers with a knife in a Burger King parking lot. The department’s longtime spokesperson, Pat Camden, said at the scene that McDonald posed “a very serious threat,” leaving one officer no choice but to lodge a fatal bullet into the teenager’s chest.

Reporters and a few witnesses were skeptical of this account, especially after the Cook County Medical Examiner announced that McDonald in fact had “multiple” gunshot wounds. An autopsy later revealed that McDonald had been shot 16 times, in different places all over his body.

Jamie Kalven, the freelance journalist who first obtained the autopsy through a Freedom of Information Act request, called these details “the silent testimony of Laquan McDonald’s corpse.”

Gunshot wound of the left scalp. Gunshot wound of the neck. Gunshot wound of the right upper leg. And so on.

At least two bullets appeared to have gone through McDonald’s back.

The medical examiner described a “well-developed, well-nourished” young man with dreadlocks and several tattoos. One on the right arm read “Quan”; another on his right hand read “Good Son”; a last on the other hand depicted a pair of dice accompanied by the catchphrase “YOLO,” short for “You Only Live Once.”…Read the Rest of this developing story here
