Police chief clarifies how Texas teen Jordan Edwards was shot dead by officer

BALCH SPRINGS, Texas — A suburban Dallas police chief acknowledged Monday that an officer who fatally shot a black 15-year-old in a moving vehicle fired as the car was driving away — not as it reversed toward officers, as the department had previously asserted.

Balch Springs Police Chief Jonathan Haber told reporters that police video contradicted his department’s original statement about the Saturday night shooting of Jordan Edwards. Edwards, a high school freshman, had gotten into a vehicle with four other teenagers to leave a house party as police were arriving to investigate an underage drinking complaint, according to his family’s attorney, Lee Merritt.

Police first said the vehicle backed up toward police at the scene “in an aggressive manner.” But Haber said Monday that police video shows the vehicle was instead “moving forward as the officers approached.”

Before Haber’s update, Merritt and the teen’s family held their own news conference, during which Merritt accused police of “offering facts that they believe paint a picture that would justify the unjustifiable.” He later told the Associated Press that Jordan’s shooting brings to mind the high-profile deaths of other black people after police encounters that have sparked outrage and protest in recent years, but that this case stood out for its “sheer recklessness.”

“This has happened far too often,” Merritt said. “We are tired of making the same rhetorical demands, of having the same hashtags.”

Indeed, thousands of Facebook and Twitter users have posted about the case in recent days with the hashtag “#jordanedwards,” some comparing his death to other police shootings of young black men, such as 12-year-old Tamir Rice in Cleveland who was fatally shot in November 2014 as he held a pellet gun.

Merritt said Edwards’ family wants to see the officer fired and criminally charged. The police chief called for time to let authorities complete their investigations. Haber wouldn’t identify the officer and didn’t release his race, but said he had been “removed from all duties” and placed on leave.

Haber also wouldn’t release the police video or describe it in detail other than to acknowledge he erred in describing the encounter, but said he was troubled by what he saw.

“I do have questions in relation to my observation on the video, and what is consistent with the policies and core values of the Balch Springs Police Department,” Haber said.

Balch Springs’ official use-of-force policy encourages officers facing an oncoming vehicle to “attempt to move out of its path, if possible, instead of discharging a firearm at it or any of its occupants.” The policy was posted online by ‘Point of Impact,’ a series on police shootings reported by freelance journalist Eva Ruth Moravec. It echoes advice given by the International Association of Chiefs of Police.

Haber did not return phone and email messages Monday seeking clarification about whether he believed the officer violated the policy on Saturday night. The Dallas County district attorney’s and sheriff’s offices are investigating the shooting. A spokeswoman for the sheriff said its probe was in the “preliminary stages.”

The original police statement about the shooting said officers responded to a report of “several underage kids drunk walking around.” It doesn’t specify whether the passengers of the vehicle in which Jordan was riding were among them.

Merritt said there was no alcohol found in the car and no evidence that the passengers had been drinking.

The Dallas County Medical Examiner confirms a rifle shot to the head as Edwards’ preliminary cause of death, reports CBS Dallas / Fort Worth..

The Dallas County Sheriff’s Department is the lead agency for the criminal investigation.

Prince William County has a deplorable racial history. It was the site of the longest running school desegregation effort in the country in the 60’s. They actually shut the public school system down for four years, building “Charter” Private Schools for the white kids so they didn’t have to integrate. More recently, they came up with the brilliant idea that illegal aliens shouldn’t be able to buy houses there and demanded to check everyone’s citizenship status. They yanked their real estate market for 6 years behind that one.

Teen Charged With Stealing 65-Cent Milk Carton To Go To Trial

Ryan Turk’s family says the 14-year-old was handcuffed, searched for drugs and suspended from school.

A 14-year-old Virginia boy will face trial after he was charged with stealing a 65-cent milk carton from his school cafeteria ― despite being enrolled in the free-lunch program.

Police arrested and charged Ryan Turk with two misdemeanors of disorderly conduct and petit larceny in May after a school resource officer claimed to have seen him “conceal” the drink at Graham Park Middle School, according to the Prince William County Police Department.

The debacle ended with Turk being handcuffed, suspended and allegedly searched for drugs in the school principal’s office, his mother alleged in an interview with WTVR shortly after his arrest.

The boy’s family has since accused the officer and school of unfairly targeting him because he’s African-American. They declined to handle his arrest non-judicially, police said, leading to a trial date being set for November, The Washington Post reports.

The acting officer, who is with the Prince William County Police Department, reported seeing Turk take the beverage after cutting in his school’s lunch line on May 10, police said.

Turk told WTVR after his arrest that he had forgotten to pick up the drink during his first pass through the line. He put it back and explained himself after being the officer confronted him, the teen added.

When he was ordered to go to the principal’s office, however, things apparently got hostile.

Police said in a statement, which The Huffington Post obtained, that the boy “refused and became disorderly.”

“When the officer attempted to escort him to the office, the student leaned back and pushed against the office,” the statement read. “As they were approaching the principal, the student attempted to push past the officer to get away. The student was subsequently handcuffed and taken to the office without further incident.”

Turk admitted that he did pull away from the officer and told him to get off of him. He said the officer grabbed his neck in response.

The family’s attorney, Emmitt Robinson, argued that it was merely a case of someone not wanting to go along with someone who was being unfair. But he also alleges that Ryan was targeted and accused of stealing because of his race.

The 14-year-old boy was enrolled in his school’s free lunch program, so he was entitled to the milk without paying, his family has said.

“No one needs to be punished for stealing a 65-cent carton of milk,” Robinson told The Washington Post last week. “This officer treats kids like they’re criminals, and guess what happens — they’re going to become criminals.”

The boy’s mother, Shamise Turk, said her son’s ordeal left her “angry” and “frustrated.”

“It just went too far,” she told WTVR. “They are charging him with larceny, which I don’t have no understanding as to why he is being charged with larceny when he was entitled to that milk from the beginning.”

She said that her family’s decision to go to trial is over wanting to set the record straight.

“My son is not going to admit to something he did not do,” she told The Washington Post.

A spokesman for Prince William Public Schools said in a statement Monday that it had no role in how the situation was handled, beyond academic discipline. Local authorities brought the legal charges and police action, he said.

The school suspended Turk because his actions broke its code of conduct, school spokesman Philip B. Kavits wrote.

“As every parent and student knows, principals must look at how a student behaved, and how that behavior affects both the student and others at the school. Following that determination, principals act in the best interest of all concerned,” he added.

Addressing allegations of racism, Kavits  noted that both the school’s principal and the police officer that handled his arrest are African-American.

“These individuals are well known in our highly diverse community for their dedication and caring approach to ALL students,” he wrote.

Requests for comment from Robinson and Shamise Turk were not immediately returned.

In what has seemingly become a growing pattern of racially motivated attacks, comes the report of yet another murder of a African-American by apparent white supremacists.

19 year-old Larnell Malik Bruce and a group of friends were gathered outside a 7-11 store in Gresham, a small town located near Portland, when Russell Courtier, 38, and his girlfriend Colleen Hunt, 35, pulled up in their 1991 red Jeep Wrangler shortly before midnight on August 10. Bruce, who was just a few days shy of his 20th birthday, had been charging his phone outside the convenience store when the white couple nearly twice his age exited their vehicle.

For reason still unclear, a fight quickly broke out.

As Courtier smashed Bruce’s head into the store’s front window, cracking a pane of glass, his girlfriend encouraged the beating.

“Get him, baby,” Hunt urged her boyfriend, according to police. “Get him, baby!”

Eventually, Bruce pulled out a machete and the couple retreated back to their Jeep.

What happened next can perhaps best be described as a scene from the violent Jim Crow South.

Investigators said Bruce tried to run away from the couple who began to chase him down in their car. Security camera footage shows the teen doing his best to zigzag away from the SUV. Per the Portland Mercury, Courtier and Hunt barley missed Bruce as they gunned the car toward him on the sidewalk. As he tried to cross the street, the couple’s Jeep is seen moving into oncoming traffic and hitting the teenager head-on, although the direct impact is not caught on camera.

Police, who had been called by a 7-11 employee when the fight intital broke out, arrived on the scene just moments later to find the critically injured teen with blood gushing from his head and his ears lying in the middle of the street.

Bruce died from his injuries days later.

Prison records obtained by the Portland Mercury reveal that Courtier is a longtime criminal with a notorious history as a member of a white supremacist prison gang called European Kindred (EK) who was on parole at the time of killing:

In February 2004, while still in prison, Courtier was busted for getting that logo tattooed on his calf and for having a “make-shift tattoo gun” and extra ink in his cell (see that record here). Just two months later, he brawled with a black inmate in the crowded prison yard before “a group of white inmates faced off against a group of black inmates,” records show (document).

And in 2005, while at SRCI, a letter he wrote to another EK member—intercepted by prison staff—indicated he needed backup from his gang because he was “getting run up on by redskins.” (document) That year, Courtier was also accused of throwing a piece of shit-smeared paper at a guard who was a person of color, and later threatened to “take care” of him when he got out.

In total, Courtier was accused of nearly 40 “major” prison violations between 2001 and 2013—for assaults, for joining and associating with EK members, for his prison tattoos (he was busted in 2005 for tattooing “party bone” on his penis, for instance), for having contraband in his cell, for disrespect, for not following rules (see his entire DOC discipline record here).

He hasn’t fared much better outside of prison. Courtier’s had seven felony and four misdemeanor convictions, court records show. He also has an extensive juvenile record that includes multiple assaults and burglary.

Video Surfaces of NYPD Officers Shooting Unarmed Black Teen Trying to Surrender

Another one of those cases of absolutely over the top cops. First shooting at a kid running away, and then continuing to shoot when the suspect stops and raises his hands. Fortunately this one didn’t end in Murder by Cop.

Newly-released video undermines New York City police’s claim that a teenager was threatening them with a toy gun when they fired at him 16 times during a December 2013 encounter, the New York Daily News reported.

The footage shows Keston Charles, who was 15 years old at the time, running from officers, then limping, then putting his hands up with no sign of the BB gun he was reportedly carrying, which he allegedly took from a friend during a neighborhood fight and used to threaten another boy.

Charles served 18 months of probation in connection with the incident, and is reportedly trying to obtain his GED.

“I was scared for my life. I was trying to get away,” Charles said of the encounter. “I never been shot at before.”

Charles was hit three times — twice while surrendering at the front door of his apartment building in Brooklyn. Charles is now suing Officer Jonathan Rivera over the incident.

An attorney for the city of New York, Elissa Jacobs, said that Charles “did not put his hands up to surrender before any round of shots,” a statement apparently contradicted by the footage. According to court documents, officials said since Charles was only hit three times, it demonstrated “how fast he continued to move and that the threat to public safety had not been abated.”

Chicago – Paul O’Neal Murder By Cop

Chicago police officer shot Paul O’Neal in back, autopsy shows

 Paul O’Neal, the black teenager who was killed by Chicago police, died of a single gunshot wound to the back, the Cook County medical examiner’s office confirmed in an autopsy report released Wednesday.

The teen did not have any illegal drugs in his system, CBS Chicago reports.

A Chicago police officer shot and killed O’Neal July 28, in an incident that was partly captured on video. The medical examiner’s office report stated that O’Neal was seen driving a 2002 Jaguar, a vehicle that had been reported stolen.

O’Neal, 18, reportedly refused to stop the vehicle and “rammed head on” into a marked squad car, injuring two officers. After the impact he got out and ran.

“During the foot pursuit shots were fired by other unidentified officers on the scene and possibly by O’Neal,” the medical examiner’s report says. However, investigators have determined that O’Neal was unarmed.

An officer, allegedly believing shots were fired by O’Neal, fired his “Glock 9mm handgun five times in an attempt to stop the threat,” the report states.

O’Neal was struck by a single bullet in the right side of his back, according to the report.

Naked, Unarmed Black Teen Shot and Killed By Austin Texas Police

Here we go again. How is a slight, unarmed teenager with what would seem to be an obvious mental condition a danger to a Police Officer?

12:45 p.m. update: Austin police identified the person shot and killed by an officer on Monday in Northeast Austin as David Joseph, 17.

Police also identified the officer involved in the shooting as Geoffrey Freeman, a veteran officer who joined the force in 2005.

“All of our officer-involved shootings are tragedies,” Austin police Chief of Staff Brian Manley said.

Concurrent investigations are underway, Manley said, including a criminal investigation being conducted by the Special Investigations Unit and the district attorney’s office.

Manley confirmed that Joseph was unarmed when he was shot Monday morning.

Police had responded to a call in the 300 block of Yager Lane that a man was chasing someone through an apartment complex, Manley said. Officer Freeman had been talking to witnesses when he responded to a call nearby in the 12000 block of Natures Bend, he said. There, Freeman encountered Joseph and within seconds of the confrontation, he opened fire, Manley said.

Freeman provided an initial statement at the scene but is expected to provide a more lengthy statement for investigators later this week, Manley said.

Manley declined to talk about whether the victim had any previous police record or a history of mental illnesss.

“Now is not the day,” he said.

Earlier: A man fatally shot Monday by an Austin police sergeant was not armed at the time of the incident, three sources told the American-Statesman and KVUE-TV today.

Officials had said at the scene that they did not know whether the man, who was naked at the time, had a weapon when he was shot in North Austin.

However, the sources, who were not authorized to speak because of the ongoing investigation, said investigators have since confirmed the unidentified man did not have a weapon.

The revelation intensified questions about the officer’s decision to shoot. Austin police have called a noon news conference at Austin police headquarters to discuss the shooting.

The sources said a key issue in the case likely will be the distance between the officer and the man and whether or not the officer can demonstrate that he was in immediate danger.

Most officers in the department also carry stun guns.

The shooting happened about 10:30 a.m. Monday in the 12000 block of Natures Bend in a small neighborhood south of Tech Ridge Boulevard near Yager Lane. Several residents had called police and said that a man was running around the neighborhood and acting erratically.

Both the suspect and officer in the incident are black. Nelson Linder, president of the Austin NAACP, said the incident highlights the need for police to review how they handle similar situations in the future.

“Once again it is very clear that this policy of response to resistance is not being enforced,” Linder said. “They need to rethink this whole approach, especially if there might be mental illness issues.”

Meanwhile, Jim Harrington, the longtime director and founder of the Texas Civil Rights Project who is retiring, condemned the incident in a statement Tuesday.

“It is almost incomprehensible that a young naked man would be considered dangerous such that a police officer would kill him,” he said. The social advocacy group has called for “a full, fair, and open investigation” of the shooting.

“This is the pattern that led to the U.S. Department of Justice investigation a few years back, and it appears that the pattern of police shootings continues,” Harrington said. “We intend to pursue this matter with the Department of Justice once more.”

SC School Cop Body Slams and Throws HS Girl Across Room

This one is hard to watch.

Parents outraged over video of confrontation between high school student and school resource officer

RICHLAND COUNTY, S.C. — A school district in South Carolina is investigating the actions of a school resource officer after video circulated widely on social media Monday showing him violently removing a student from her desk.

It’s not known what led up to the incident Monday at Spring Valley High School in Columbia.

WIS-TV reported the student was asked to leave the classroom. When she refused, the officer was called in, according to WIS-TV.

The officer, identified as Ben Fields, can be heard on cell phone video telling the girl to get up from her desk.

“You’re either going to come with me, or I’m going to make you,” he says.

When she remains seated, he tells her, “Come on, I’m going to get you up,” before picking her up from the desk and throwing her to the floor.

As he continues to try to restrain her, she is thrown several feet across the classroom as the officer tells her repeatedly to put her hands behind her back.

Richland School District Two Superintendent Dr. Debbie Hamm said in a statement that safety is the district’s “top priority,” and that officials are working with the Richland County Sheriff’s Department in an investigation.

“The district will not tolerate any actions that jeopardize the safety of our students,” Hamm said.

The officer has been told not to return to school during the investigation and has been placed on administrative leave by the Sheriff’s Department.

The video was trending on Facebook and the hashtag #AssaultAtSpringValleyHigh was the No. 1 trending topic Twitter on Monday night as people reacted to the incident. Many expressed shock at the force used, while others noted the girl was not complying with the officer’s demands.

Facebook users inundated the Richland County Sheriff’s Department with comments expressing outrage over the officer’s actions and called for his firing.

A spokesman for the department said Sheriff Leon Lott is aware of the video and “was very disturbed by it.”

“He has questions like everyone has — and he wants answers and once he has those answers, he will address them,” said Sheriff’s Department spokesman Lt. Curtis Wilson.

Fields did not immediately respond to CNN’s request for comment Monday night.

Parents of students at the high school are reacting to the video. A group called the “Richland Two Black Parents Association” called the video “unacceptable.”

“Parents are heartbroken as this is just another example of the intolerance that continues to be of issue in Richland School District Two particularly with families and children of color,” the group said in a statement, according to WIS-TV. “As we have stated in the past, we stand ready to work in collaboration to address these horrible acts of violence and inequities among our children.”
