SCUMUS 5…No More

Wow! A chance for the Supreme court to be Supreme again!

Now…If only his shadow, Uncle Tommie would give up the ghost.

Supreme Court Justice Antonin Scalia found dead in Texas

U.S. Supreme Court Justice Antonin Scalia was found dead Saturday, CBS News has confirmed.

According to the San Antonio News-Express, which was first to report his death, Scalia was found dead in his room at a West Texas resort.

Scalia, 79, was one of the staunchest conservative members of the court. He was nominated in 1986 by President Ronald Reagan and is the longest-serving member on the court.

He championed the philosophy of “orginalism,” meaning he interprets the Constitution according to what he believes the original authors intended over 200 years ago.

In a 2008 interview with “60 Minutes,” he told correspondent Lesley Stahl that he believes the Constitution is an “enduring” document he wants to defend….

His replacement to the court would be President Obama’s third nomination. He previously nominated Justices Sonia Sotomayor and Elena Kagan. But CBS News Chief Legal Correspondent Jan Crawford said it is unclear whether the Republican-held Senate will entertain a nomination from Mr. Obama or wait for a new president to be elected this November.

“It could be very unlikely that President Obama that will get that nomination,” Crawford said. “This court could remain with eight justices until the next president takes office. I think that’s very unclear what will happen.”

“This vote will change the balance of the Supreme Court if a liberal is nominated,” she added.

Clarence Thomas Tries Defending SCOTUS Sell-Out of Democracy

Sung by the massive criticism over their recent 5-4 decision that corporations have unfettered rights to purchase politicians, Justice Thomas attempts to explain the decision.

Not being a Constitutional Lawyer, I have a question. If corporations enjoy the same rights as people…

Do they not also share the same responsibilities, and as such are liable to the law?

Ergo, if a corporation is responsible for killing or harming people through some act of malfeasance or neglect…

Then why can’t the corporation be charged with capital murder?

In which case it’s officers would be subject to the same criminal penalties, up to and including the death penalty as any corporal person.

The War For Justice – Democrats Step Up

Since the 2000 (S)election where 5 Republican Judges illegitimately installed a Republican President, progressive discontent with the direction of the judiciary has grown.  Stung by decisions by a “Liberal” court during the Civil Rights era which ruled in favor of Civil Rights for Minorities and tore down much of the Jim Crow System, the conservative’s obsession with stacking the courts and the Judicial System reached fevered peaks. The result after three Republican Presidencies in the last 30 years has produced a Judicial nightmare where minorities have no hope of receiving justice or respect for their Civil Rights in courts dominated by conservative sycophants and conservative minority appointments whose singular qualification is to share skin color…

And to have the same respect for other minorities as a KKK Grand Wizard at a lynching.

Turning the Supreme Court Into a Political Toilet

The Supreme Court of the land, and it’s 5 member conservative majority has become a joke, not because of issues with strict constitutionalism or contructionalism – but their complete  and entirely a whore of the Republican Party even to the extent of bending and breaking their own strict constitutional standards.

Kickback?

President Obama finally got the “party” going at the SOTU, at the SCUMUS 5 decision to prostitute our Democracy to the highest bidder, whether that bidder be domestic or foreign.

Democrats Declare Rhetorical War on the Supreme Court

President Obama’s public undressing of the robed Supreme Court justices seated in front of him at the State of the Union address turned heads and drew rebukes from Republicans.

But his words were downright genteel compared with what’s been said on the Senate floor the past two days. Democrats on Capitol Hill accused conservative court members of deciding cases specifically to benefit the Republican Party. Read the rest of this entry »

Clarence Thomas To Other Justices: Be Quiet!

This one is stranger than usual from Clarence Thomas. Justice Thomas is known for his silence on the court, going years without asking a single question of the Attorney’s presenting cases before the Supreme Court. Now we find up it is because he has already made up his mind before hearing the oral arguments…

Clarence "My Mind is made up, and you aren't going to change it" Thomas

TUSCALOOSA, Ala. — Clarence Thomas, the justice long known as the silent member of the Supreme Court, criticized his colleagues Friday for badgering attorneys rather than letting them speak during oral arguments.

Thomas – who hasn’t asked a lawyer a question during arguments in nearly four years – said he and the other eight justices virtually always know where they stand on a case by reading legal briefs before oral arguments.

“So why do you beat up on people if you already know? I don’t know, because I don’t beat up on ‘em. I refuse to participate. I don’t like it, so I don’t do it,” Thomas said during an appearance before law students at the University of Alabama.

Thomas didn’t name names, but fellow conservative Justice Antonin Scalia is generally considered the court’s most aggressive questioner during oral arguments. President Barack Obama’s lone nominee so far, Justice Sonia Sotomayor, isn’t afraid to ask questions either.

Thomas scoffed at the idea that the justices try to use questions to influence the opinions of fellow members of the court.

“All nine of us are in the same building,” he said. “If we want to sway each other we know where we are. We don’t need oral arguments to do that. It doesn’t make any sense to me.”

Just another good reason to hope for several Court retirements during Obama’s First Term…

Including Thomas’.

A little Funk for Clarence –
