“Activist Judges Caused the Holocaust” – Supreme Court Judge Antonin Scalia

After his outburst a few weeks ago, I am believing Scalia has a case of advanced Dementia – and probably shouldn’t be on the Court. That the Nazi takeover of Germany, and the Holocaust was caused by “activist Judges” is out there in Fruit-Cake land…

But that’s not the first time for Scalia…

Antonin Scalia: Holocaust Was Partially Brought About By Judicial Activism

Supreme Court Justice Antonin Scalia’s warnings on judicial activism appear to have gained a new chapter at the Utah Bar Association’s 2013 summer convention.

The Aspen Times reported Sunday that Scalia drew upon the Holocaust as an example of how judicial activism can lead to problems. According to the Utah Bar Association’s website, Scalia was slated to be the keynote speaker for the 2013 Summer Convention event, which was held from July 17-20 in Snowmass, Colo.

Scalia opened his talk with a reference to the Holocaust, which happened to occur in a society that was, at the time, “the most advanced country in the world.” One of the many mistakes that Germany made in the 1930s was that judges began to interpret the law in ways that reflected “the spirit of the age.” When judges accept this sort of moral authority, as Scalia claims they’re doing now in the U.S., they get themselves and society into trouble.

About a month ago, Scalia delivered a speech to the North Carolina Bar Association, stressing his concern about how moralist judges are growing more prevalent.

Justice Antonin Scalia disrupted the normally tranquil atmosphere of the Supreme Court today, bursting from his office to shout, “I’m never going to another damn N.B.A. game as long as I live!”

While it was unclear what, exactly, had provoked Justice Scalia’s outburst, one of his clerks said that “he saw something on ESPN that really upset him.”

After emerging from their offices to see the source of the commotion, the other Justices found a visibly agitated Justice Scalia, his face beet-red and his entire body shaking with rage.

“I’ve gone to basketball games my entire life,” he bellowed. “I always thought that was a ‘safe place.’ Well, I guess I was wrong. I guess I’ve been wrong about a lot of things, haven’t I? Haven’t I?”

As Justice Clarence Thomas wordlessly moved to comfort him, Justice Scalia rebuffed his fellow-juror.

“Get away from me, Clarence!” he screamed. “I can’t trust anyone anymore.”

His Outburst in the Court in May as the Court considered Gay Rights -

As Justice Anthony Kennedy questioned whether it was appropriate for the Court to hear a case about same-sex marriage at this time, Mr. Scalia stunned observers with an emotional outburst.

“O.K., could we just stop talking about this stuff right now?” Justice Scalia snapped at Justice Kennedy. “I’ve told you all how I feel about this topic, and I don’t understand why we’re going on and on about it unless you all hate me.”

As the courtroom froze in dead silence, Justice Scalia seemed to gather steam, shouting, “For two days, it’s been gay this, gay that. You’re all just talking about this stuff as if it’s the most normal thing in the world. Well, it’s not, O.K.? It’s weird and it’s wrong. And just talking about it like it’s O.K. and whatnot is making me angry beyond belief.”
As the other justices averted their eyes, Justice Scalia broke down, sobbing that he wished “things were normal, the way they used to be.”

And then there was the Voting as a “racial entitlement”.

Justice John Roberts Whine

This one makes you shake your head. John Roberts, one of the most political, ideological appointees in the history of the Court weeping because the President of the United States recognized the fact that the Supreme Court has degenerated into an ideological freak show. Roberts was the scumbag who took the 5th, claiming he had no memory of joining the infamous Federalist Society – despite him being listed as a member 10 years previously.

John Roberts, who replaced Rehnquist as the chief justice in 2005. That year, Newsday reported that Roberts had made racist and sexist jokes in memos that he wrote while working in the Reagan White House. And, The New York Review of Books published a scolding article in 2005 making the case that during the same period that he was making those jokes, Roberts marshaled a crusader’s zeal in his efforts to roll back the civil rights gains of the 1960s and ’70s — everything from voting rights to women’s rights. The article began, “The most intriguing question about John Roberts is what led him as a young person whose success in life was virtually assured by family wealth and academic achievement to enlist in a political campaign designed to deny opportunities for success to those who lack his advantages.”

Roberts: Scene at State of the Union ‘Very Troubling’

U.S. Chief Justice John Roberts said Tuesday the scene at President Barack Obama’s first State of the Union address was “very troubling” and that the annual speech to Congress has “degenerated into a political pep rally.”

Responding to a University of Alabama law student’s question about the Senate’s method of confirming justices, Roberts said senators improperly try to make political points by asking questions they know nominees can’t answer because of judicial ethics rules.

“I think the process is broken down,” he said.

Obama chided the court for its campaign finance decision during the January address, with six of the court’s nine justices seated before him in their black robes.

Roberts said he wonders whether justices should attend the address.

“To the extent the State of the Union has degenerated into a political pep rally, I’m not sure why we’re there,” said Roberts, a Republican nominee who joined the court in 2005. Continue reading

Sung by the massive criticism over their recent 5-4 decision that corporations have unfettered rights to purchase politicians, Justice Thomas attempts to explain the decision.

Not being a Constitutional Lawyer, I have a question. If corporations enjoy the same rights as people…

Do they not also share the same responsibilities, and as such are liable to the law?

Ergo, if a corporation is responsible for killing or harming people through some act of malfeasance or neglect…

Then why can’t the corporation be charged with capital murder?

In which case it’s officers would be subject to the same criminal penalties, up to and including the death penalty as any corporal person.

The War For Justice – Democrats Step Up

Since the 2000 (S)election where 5 Republican Judges illegitimately installed a Republican President, progressive discontent with the direction of the judiciary has grown.  Stung by decisions by a “Liberal” court during the Civil Rights era which ruled in favor of Civil Rights for Minorities and tore down much of the Jim Crow System, the conservative’s obsession with stacking the courts and the Judicial System reached fevered peaks. The result after three Republican Presidencies in the last 30 years has produced a Judicial nightmare where minorities have no hope of receiving justice or respect for their Civil Rights in courts dominated by conservative sycophants and conservative minority appointments whose singular qualification is to share skin color…

And to have the same respect for other minorities as a KKK Grand Wizard at a lynching.

Turning the Supreme Court Into a Political Toilet

The Supreme Court of the land, and it’s 5 member conservative majority has become a joke, not because of issues with strict constitutionalism or contructionalism – but their complete  and entirely a whore of the Republican Party even to the extent of bending and breaking their own strict constitutional standards.

Democrats Declare Rhetorical War on the Supreme Court

President Obama’s public undressing of the robed Supreme Court justices seated in front of him at the State of the Union address turned heads and drew rebukes from Republicans.

But his words were downright genteel compared with what’s been said on the Senate floor the past two days. Democrats on Capitol Hill accused conservative court members of deciding cases specifically to benefit the Republican Party. Continue reading
